Terms of service

The terms for using this website and the Alayan client portal.

Draft for review. These terms must be reviewed by a qualified legal professional before the site launches publicly.

Our services

Alayan Design-Build Inc. provides small building design, Ontario Building Code analysis and permit documentation services for Part 9 small buildings. We do not perform construction, act as a general contractor or supervise construction. The scope, fees and deliverables for each project are set out in a separate written proposal or agreement, which takes precedence over these terms.

Professional scope

Design and permit documentation services are provided within the scope permitted for the qualified designers performing them under Ontario's Building Code Act, 1992 and the Ontario Building Code (O. Reg. 332/12). Where a project or a part of it requires a licensed architect under the Architects Act or a professional engineer under the Professional Engineers Act (for example, buildings outside Part 9, or engineered structural or mechanical design), we'll tell you, and you'll need to retain the appropriate licensed professional directly. Coordinating with or managing other professionals is not part of our services. Qualifications published on this site are listed only after verification.

Permits

Building permits are reviewed and issued by the relevant municipality. Alayan does not issue permits and does not guarantee approval or approval timelines. Permit drawings prepared by Alayan are sealed by our BCIN-qualified designer. Services that include permit drawings carry a permit administration fee, a percentage of the design fee (5% unless your proposal says otherwise). Building permit fees, development charges and any other fees charged by the municipality or other agencies, as well as surveys and third-party reports, are not included in our quotes unless agreed in writing. Our quotes cover BCIN small building design services only (Ontario Building Code, Part 9); Alayan does not provide construction, contracting or site supervision.

Discounts and promotions

Package savings and promo codes can't be combined: one discount applies to a quote or invoice, whichever saves you the most. Promotions apply to the design fee before tax and the permit administration fee.

Website information

Content on this website, including the fee estimator, 3D tours and the Design Style Assessment, is general information and not professional advice for your specific project. Estimates are indicative only. Concept, proposed and illustrative designs are labelled as such. We don't publish testimonials or project claims we can't verify.

Client accounts

  • Keep your password confidential, and tell us right away if you think your account has been misused.
  • Don't try to access projects or files that aren't yours, or interfere with the site's security.
  • We may suspend or close accounts that break these terms or are used for misuse.

Drawings and 3D models

© Alayan Design-Build Inc. Unless your agreement says otherwise, Alayan owns the copyright in its drawings, CAD files, details, 3D models, 360° tours, renderings and portfolio photographs, under Canada's Copyright Act. You may use the documents we deliver for your own project (including permit applications and construction of that project). You may not copy, publish, sell or reuse them for another project without our written permission. A drawing is not for construction unless it is clearly marked with that status.

The rest of this website (text, images, design and code) is also © Alayan Design-Build Inc., except third-party content credited as such.

Liability

To the extent permitted by law, Alayan isn't liable for indirect or consequential losses from use of this website. Our responsibility for professional services is set out in your agreement. Nothing in these terms limits rights you have under Ontario's Consumer Protection Act, 2002 or other laws that can't be waived.
